TOYOTA Tsusho America has filed a lawsuit in the Southern District of Texas against the vessel Oriental Saga, alleging negligence and breach of contract, in a bid to recover damages of US$167,179 over claims a shipment of stainless steel pipes it transported from Shanghai arrived at the port of Houston damaged.
According to the lawsuit, Toyota tendered in good order and condition to Oriental and China Sailing at Shanghai a cargo of stainless steel, seemless pipes, at the end of August 2014. Oriental and China Sailing, the chartering company, agreed safely to receive, handle, load, stow and deliver the cargo to Houston, the complaint states, reported SETexasRecord.com.
On January 5, 2015, the moving vessel Oriental Saga arrived at the port of Houston where, according to the lawsuit, much of the cargo was dented, bent, bowed and contaminated.
