Yangtze Memory Technologies has filed a lawsuit against the Pentagon, seeking removal from its Chinese military company list, citing lack of notice.
Chinese chipmaker Yangtze Memory Technologies has filed a lawsuit against the US Department of Defense, seeking removal from the Pentagon's list of Chinese military companies, according to reports from Caixin. The company claims it was designated twice without prior notice or an opportunity to respond.
The complaint, filed on December 5, states that the Defense Department first placed Yangtze Memory on the list on January 31, 2024, and again on January 7, 2025. Being listed has caused reputational damage and restricts access to US grants, loans, contracts, and other benefits.
Yangtze Memory reported that it spent over 10 months attempting to engage with the department through outside counsel to understand the basis for its designation and to provide evidence disputing it. However, the company stated that the agency never responded.
After exhausting what it described as all reasonable administrative remedies, Yangtze Memory decided to pursue legal action, arguing that the listings were unjustified and detrimental to its business.
