THE Philippines Anti-Red Tape Authority (ARTA) has expressed its willingness to review the regulatory impact statement (RIS) of the Philippine Ports Authority (PPA) concerning its controversial container registry and monitoring system, reports Manila's PortCalls Asia.
Following the stakeholders' consultation meeting, where concerns were raised regarding PPA Administrative Order (AO) No. 04-2021, arta stated that a 'potential review and re-evaluation' of the PPA's RIS on the policy might be necessary.
During the potential review of the PPA's RIS, ARTA will take into consideration the issues raised by stakeholders. AO 04-2021 outlines the registration and monitoring policy for foreign containers entering and leaving PPA ports.
It mandates that foreign containers register with PPA's Trusted Operator Programme-Container Registry and Monitoring System (TOP-CRMS) and obtain container insurance.
In January, the implementation of TOP-CRMS was indefinitely deferred by the PPA Board due to calls from various stakeholder groups to scrap the programme.
The consultation meeting was organised after the Philippine Chamber of Commerce and Industry (PCCI), Alliance of Concerned Truck Owners and Organisations (ACTOO), Association of International Shipping Lines (AISL), and other organisations wrote to ARTA, raising concerns about alleged inaccuracies in the PPA's submitted RIS compared to actual on-ground data.
ARTA received the initial RIS for AO 04-2021 in January 2023, followed by several revisions. On March 3, ARTA provided the PPA with the evaluation result of its RIS, which scored 36 out of 40, indicating a 'good practice' rating. This implies that there were areas in the analysis or process that could have been improved to enhance the quality of the RIS.
The submission of the RIS aligns with Section 5 of Republic Act 11032, also known as the Ease of Doing Business and Efficient Government Service Delivery Act of 2018. This provision mandates that proposed regulations from covered government offices undergo an RIS to ensure they do not impose unnecessary burdens and costs on stakeholders and to prevent regulatory overlap.
