USAF Major General Phillip Stewart was acquitted of raping a subordinate but found guilty of a 'bottle-to-throttle' violation for going up in a C-17 Globemaster within 12 hours of consuming alcohol, reported the San Antonia Express-News.
This resulted in Stewart being restricted to Joint Base San Antonio-Randolph for two months and docked US$60,000 in pay over six months. He also could have his rank reduced in a separate proceeding.
Stewart was found guilty of flying a giant C-17 cargo plane less than 12 hours after consuming alcohol, in violation of an air force 'bottle-to-throttle' rule.
The evening began with members of his command outside his guest house at Altus AFB in Oklahoma on April 13, 2023. They knocked on his door, then on a bedroom window. Stirred awake, Stewart told them he needed 20 minutes. He then showed up late for a breakfast held to honour him and a fellow general.
Next, short on sleep and after a night of drinking that ended in sex with a subordinate officer, he flew a giant C-17 cargo plane in manoeuvres that included low-level passes, touch-and-go landings and mid-air re-fuelling.
Fourteen months later, Stewart was court-martialled for the 'bottle-to-throttle' infraction, along with other charges stemming from the trip to Altus, including two counts of sexual assault.
At Fort Sam Houston in San Antonio, a jury of eight three-star generals acquitted Stewart of sexually assaulting the female subordinate. Stewart did not dispute having sex with her but said it was consensual.
The jury, however, found him guilty of dereliction of duty for 'assuming control of an aircraft after consuming alcohol within 12 hours prior to take-off.'
