Wan Hai Lines mandates accurate cargo declarations, imposing $100,000 penalties for inaccuracies to ensure safety and compliance in shipping.
Accurate cargo declarations are critical in container shipping, impacting vessel booking, load planning, customs oversight, and, most importantly, safety at sea. Misrepresentation or errors in cargo declarations can lead to severe safety risks, including fires or explosions, causing catastrophic losses to vessels and cargo. Even for non-hazardous goods, inaccuracies can result in inspections, delays, additional costs, and legal consequences.
To address this, Wan Hai Lines has reinforced its cargo declaration compliance framework. On October 9th, through its agent Shanghai Lianjun International Ship Agency Co., Ltd., the company issued a formal notice imposing strict penalties for inaccurate cargo declarations. Whether for hazardous or non-hazardous goods, misrepresentation, omission, or errors may result in a penalty of up to USD 100,000 per container. Wan Hai Lines also reserves the right to recover all associated costs and hold responsible parties legally accountable.
Dangerous goods require accurate declaration, including hazard classification, UN number, substance details, a dangerous goods declaration, and packaging certification. Any discrepancies or omissions will result in a USD 100,000 penalty per container, payable within seven days of notification.
Non-hazardous shipments are held to the same standard. Any inaccuracies will also result in a USD 100,000 penalty per container, along with full liability for associated risks, damages, and costs. Payments must be made within seven days of notification.
Wan Hai Lines has outlined a comprehensive cost recovery process. Upon identifying misrepresentation, the responsible party must submit a USD 100,000 security deposit per container. This deposit covers downstream costs like container damage, detention fees, terminal costs, and customs charges. Demurrage fees caused by misrepresentation will be charged at three times the standard rate. If the deposit is insufficient, the responsible party must cover the remaining costs. Legal action may be pursued for further recovery, and criminal cases will be referred to judicial authorities.
Accurate cargo declarations are essential to avoid penalties, delays, and safety risks. Before booking, shippers and freight forwarders must verify all cargo details and submit complete documentation, particularly for hazardous goods. Compliance ensures safer, smoother operations and prevents significant financial and legal repercussions.
