    Court dismissed criminal case against captain

    The Elizovsky District Court of Yelizovo dismissed the criminal case against the captain of the "Anatoliy Karyakin" on the initiative of a relative. He had been accused of being responsible for the death of a sailor during a towing operation. The captain was accused of part 2 of Article 216 of the Criminal Code of the Russian Federation (violation of safety rules in the conduct of work, which resulted in the death of a person by negligence). According to the investigations, on June 23, 2017, the tug “Peresvet” was towing the "Anatoliy Karyakin" in the area of the ​​Avacha Bay inside the port of Petropavlovsk-Kamchatsky enroute from the pier of ZAO Petropavlovsk Shipyard to the pier No. 4, located along Ryabikovskaya Street. The work was supervised by the captain of the "Anatoliy Karyakin". The vessel was towed on a rope that was fastened to a metal ring welded to the side. During the investigation, it was recognized that the rod was not a towing device, so it was impossible to attach a rope to it. During the operation, the tug made a reverse maneuver. At that moment a two-kilogram rim broke off from the side of "Anatoliy Karyakin" and struck the head of a crew member of the tug at the head. On July 1, the sailor died of a trauma in a regional hospital. One of the relatives of the deceased sailor, who was recognized as the injured party during the investigation, made a petition to stop the criminal case against the captain of the "Anatoliy Karyakin". In the petition, he asked the court to dismiss the case, since the accused had redressed the damage and apologized. The appeal of the victim was satisfied. The decision has not entered into legal force and can be appealed to the Kamchatka Regional Court. Under Article 216 of the Criminal Code, the captain was threatened with up to five years of imprisonment. Source: Maritime News of Russia
