China's General Administration of Customs (GAC) has introduced tighter regulations through Announcement No. 77 (2026), significantly impacting the export of mechanical equipment such as CNC machine tools, machining centers, and lathes.
This move aims to strengthen compliance with the 'Regulations on Export Control of Dual-Use Items', requiring exporters and freight forwarders to meet stricter declaration and due diligence standards. While these changes enhance oversight, they also pose compliance challenges for freight forwarders, who may face penalties if reasonable due diligence is not fulfilled.
The updated regulations demand more precise product declarations, considering technical parameters, control precision, and linked axes rather than relying solely on HS codes or product names. Customs officials now scrutinize technical documentation more thoroughly, and delays may occur if discrepancies arise. Some machine tools may fall under dual-use export controls, increasing the need for accurate and transparent reporting.
A key risk for freight forwarders lies in information asymmetry. Clients, often focused on convenience or speed, may omit critical details or submit vague product descriptions. Without access to the technical parameters held by manufacturers, freight forwarders can struggle to verify the accuracy of declarations. However, under the new rules, relying solely on client-provided information without independent review heightens the risk of regulatory penalties, including fines or even criminal liability, for non-compliance.
