A STAY of proceedings has been requested by the US Department of Justice in its legal action against the US Airways Group and American Airlines parent AMR Corp to block the planned merger of their airlines that would create the world's largest carrier.
The move came in response to the federal government shutdown.
"Absent an appropriation, the Department of Justice attorneys and employees are generally prohibited from working, even on a voluntary basis," said the Justice Department motion, reported the American Journal of Transportation.
"This is creating difficulties for the department to perform the functions necessary to support its litigation efforts," the department added.
The filing stated that lawyers for the airlines object to the stay request.
The Justice Department and several states launched the lawsuit against the proposed merger of the airlines on August 13 amid fears that it would lead to higher fares and stifle competition. A federal judge was scheduled to hear the case without a jury beginning November 25.
