IN a submission to the US Federal Maritime Commission (FMC) member liners of the proposed P3 alliance have indicated that they may deploy containerships of up 19,200 TEU in the US trades within 10 years.
The three members, Maersk Line, MSC and CMA CGM, told the FMC they plan to use 130 ships on the transpacific and transatlantic trades in the 4,000-12,250 TEU range, with a view to increasing to 180 ships the addition of 19,200 TEUers, reports Lloyd's List.
No ships of that size currently exist given that Maersk Line's 18,270 TEU Triple-E ships are now the biggest in service. The largest vessels to call at any US ports are around 13,000 TEU and only a handful of terminals on either the east or west coast can handle ships of that size.
The submission, signed by Vincent Clerc of Maersk Line, Gianluigi Aponte of Mediterranean Shipping Co and Rodolphe Saade of CMA CGM, makes it clear that, while they will exchange market intelligence on trading conditions, costs and trade shares that can be obtained from outside sources, no information that is commercially sensitive such as freight rates will be shared, either directly or indirectly.
Each party will retain its separate identity and have completely independent sales, pricing and market functions. "This agreement does not create and shall not be construed as creating any legal entity... or joint liability under the law of any jurisdiction," the submission said.
The P3 alliance agreement will be governed by English law, any dispute to be heard by the London Court of International Arbitration.
"The vessels contributed by the parties shall be assigned to trade lanes and services in a manner that is expected to maximise operational and cost efficiencies," said the filing.
The filing states that no US-flagged vessels employed by Maersk that are also within the P3 Network will be used other than by the Danish line for the transportation of freight covered by cargo preference laws. Neither MSC nor CMA CGM operates US-flag ships.
