The Mercantile Marine Department (MMD) has submitted an initial report to the Directorate General of Shipping citing the "Amber L" as the merchant ship involved in the collision with the fishing boat "Carmel Matha". The incident claimed the lives of two fishermen, with a third still missing. To ensure the smooth and expeditious conduct of the detailed inquiry and also to protect the interest of the aggrieved, the Principal Officer, MMD, Kochi, has ordered the detention of the "Amber L" until further orders. At the time of the incident, Captain Georgiannakis Ioannis - a Greek national - was commanding the vessel while Second Officer Galanos Athanasios - also from Greece - was keeping navigational watch on the bridge and Zewana - a Myanmar national - was the designated Able Seaman. The approximate position of the collision was 14,18 nautical miles from the nearest land. The "Carmel Matha" had sailed out of the Thoppumpady harbour on June 9, and was fishing when the vessel rammed into it in the early hours of Sunday. The 14 fishermen on board, asleep at the time, were thrown overboard. They struggled for more than two hours in the deep sea. All but three of them were rescued by another boat, the "St Antony". Two bodies were recovered, while one fisherman - Moti Dhas from Assam - remained missing. The MMD said, based on digital and physical evidence, it had prima facie concluded the "Amber L" was involved in the collision with the Indian fishing boat on June 11 at 2.23 a.m. off the Kerala coast. The causes and circumstances of the incident - along with the contributing factors, violations of national or international maritime laws, if any, professional lapses and human errors - were to be included in the final report to be submitted to the Centre. A copy of the report was provided to the other agencies concerned, including the Kerala Police, said an official MMD release. The final report will also have details, including the extent of involvement of the vessels in the incident and the recommendations to avoid recurrence of such unfortunate incidents in the future. The Fort Kochi Coastal Police have already registered a case under Sections 280 (rash navigation of vessel), 427 (mischief causing damage), 338 (causing grievous hurt by act endangering life or personal safety of others) and 304 (punishment for culpable homicide not amounting to murder) of IPC.
