Capt Khatri,
You may or may not be aware of the below referred matter of serious concern. Nevertheless, I am letting you and others know. This is as latest as on 31st Jan 2012. Here it is:
In continuation, I am referring to the circular in attachment. As per my understanding, this particular attachment confirms on how casual approach the D G Shipping is taking on the reporting by Ships! These ships have to report on an id which is of Satyam! ??? Why a Satyam id? Why not a government id which is protected? All it requires is; for a good hacker to break into the satyam id and the pirates have a ready database for picking and choosing the vessel to attack! This is a serious matter. If I am wrong in my understanding, please educate me on the correct interpretation of this particular notice.
You may continue to be tight lipped by not assisting in my venture wherein I intend to protect the seafarers and the Shipping companies from the tyranny of the Somalian pirates. I am surprised no end as I have been requesting for your assistance for such a long time now and you are completely insensitive about this burning issue!. It might be sooner than you can think of before I use my rights under the RTI rules.

Further to all my trail mails to you, I wish to inform you that I was in Delhi to meet Mr. Tarun Jajoria, Director of the MM wing within the Shipping Division, who is presently on an official tour to London. The guidelines for implementation of armed guard's policy was Mr.Jajoria' brainchild. However, I did speak to his undersecretary Mr. Shishikumar who told me that Ministry of Shipping has formulated the guidelines, but the onus of the implementation is on the Directorate General of Shipping's office in Mumbai.
Now Capt Khatri, with the above information wherein I am quoting names, you are bound to provide me the required permissions for my company to operate from Indian Soil. I have already stated that I need to deploy my armed guards on Indian Flag Vessels in the month of February which I will not be able to do unless I am provided with the permissions from DGS and you being the person concerned with the permissions, I am demanding the same from you within a weekâs time failing which, I will have left with no other choice but to proceed against you legally.
Should something go wrong and my prospective clients vessel gets hijacked, I will charge you and your position, in the court of law with nothing less than âMANSLAUGHTERâ and leave you to face consequences. I have cautioned you vide this email letter. All our communications will be produced in the court of law in a stipulated time frame.
In the mean while, please note that a PIL (Public Interest Litigation) will be invoked from me in the Supreme Court of India against you in the month of February 2012. Copy of this mail is also marked to various authorities, including the print and electronic media, which you may take notice of.

Let me get right to the point Sir.
1) I have got to deploy my Operators (Commandoâs ) on some of my clients ships in the month of February 2012, which may call on the port of Mumbai or Kandla or any other port in India. Depending on various contingencies. These ships may or may not have Indians on board.
2) These ships will be transiting the high risk areas of Indian Ocean.
3) If I do not get the required permissions to operate from India, or if I do not get the clear understanding on the notification(see attachments) and the stand of DGS on the required permissions, How am I going to deploy my Commandoâs on board my clients vessel?
4) If I do not get an immediate feedback from you, these vessels will have to sail into the High risk Areas and may land up right into the clutches of the pirates.
5) Is Capt Khatri going to be responsible in such eventuality as mentioned in point no 4?
I am sorry Sir, but you are bound by the constitution to answer my above queries. God forbid but should something go wrong and my clients vessel gets hijacked, you will have to bear the entire responsibility. Please do not think that you can flex your authority and ignore my never-ending requests for your assistance. You seem to be obsessed with our personal differences. I urge you to act in the National interest. Why National interest? It is an international issue and you cannot take it so lightly as you are taking it.

When I come to meet you in your office in Mumbai, you make me wait for hours and finally answer me thus: âFOLLOW THE GUIDELINESâ. When I request you from Pune from my cell phone, your answer is âDO NOT DISTURB MEâ This is completely unacceptable. Either you are not interested in providing me with permissions or you have little or nothing to say on the matter. This is a matter of national interest and you just cannot withhold the information on basis of our personal conflict. There are families of hijacked seafarers waiting for their husbands, sons to return home from the clutches of the pirates and your non cooperation in the subject matter is astonishing! Are we all waiting for more Indians to get hijacked? Get killed by the pirates?
My Representation is lying at the DG office from 16th of December 2011. May I request you to kindly provide me with the relevant information please?

We all know that the DG Shipping is in very truth the statutory guardian of the Indian Shipping Industry, and guards jealously the standing of Indian seamen. What I choose to do certainly remains my own responsibility, the same applies to every individual, including yourself Sir. What I am talking here is something very different. DGS is a very strong body. Without the support of DGS, I cannot move a stone, I am not linking anything to DGS in my write-up but I am seeking support from DGS in terms of bringing back my fellow Seafarers back to safety from the clutches of the pirates. I will settle for nothing less. My fight against curbing the menace of piracy will continue.
When I say support, I do not mean support from Capt. Khatri but from the DGS. Your individual support in terms of providing information on certain subjects such as armed guards on merchant ships, its regulations etc was overwhelming and awe-inspiring. You made me wait for hours and finally- âFOLLOW THE GUIDELINES GIVEN IN THE NOTIFICATIONâ. Was all that you had to say when I had come seeking the required information from you, all the way from Pune. I have all the intention to reproduce even the SMSâs that we exchanged between us, in front of the camera.
You cannot escape your own individual responsibility towards the families of the Seafarers who are missing or are in captivity of the pirates. It is not so easy to say,â I or the DG shipping can not be linked with it at allâ.
This is a wakeup call Sir for all of us. We need to save the lives of innocents from the criminals. In doing so, every one of us will have to be linked with each other. Me, you, the media, the DGS, just about every true Indian. Jai Hind!

Counter-Piracy Operations in the Gulf of Aden

On 20 March 2010, European Union Navy ships received a distress call from the MV Almezaan on Tuesday, and responded quickly. On arrival, the Spanish-flagged naval vessel ESPS Navarra found and captured one pirate mother-ship and two small skiffs that were apparently used during the attack on the Almezaan. Six suspected pirates were arrested. Bullet holes were found in one of the skiffs, along with the body of an apparent pirate. The private security company aboard the Almezaan, armed with small arms, was greatly outgunned by the pirates, who were discovered with AK-47s and rocket-propelled grenade launchers.
Piracy has unfortunately evolved into major crisis because the only thing International Community has contributed to deter it is a handful of Naval vessels which are patrolling around 4 million sq. km of pirate infested waters, which is akin to having 17 policemen to patrol the entire area of Mumbai. Shipping Industry, despite all its regulations and authorities, has only manage to arm seafarers with water hoses and barbed wires to fend themselves against automatic weapons and rocket propelled grenades. Isnât it about time we woke up from or stupor and did something about it, or do we have to wait till the day when petrol price go through the roof because of pirates !!
Statistically speaking, today there are over at least 28 larger plus 19 smaller foreign vessels plus one stranded barge are kept in Somali hands against the will of their owners, while at least 482 hostages or captives - including a South-African yachting couple, two (or now only one) frail elderly ladies and four aid-workers - suffer to be released. Even on 27th Dec 2011, a Tanker namely Enrico Ievoli was hijacked and taken to an unknown location with 7 Indians onboard. A surge in particularly violent and highly organized attacks has hit the coast of West Africa this year, says IMBâs piracy report, listing 12 attacks on tankers off Benin since March, an area where no incidents were reported in 2010.
Some countries have been very pro-active in curbing this menace, for e.g. The US House of Representatives has passed the Coast Guard and Maritime Transportation Act, which covers the safety and efficiency of maritime transport. The bill, also called the Coast Guard Re-authorization Bill, includes a section called the Piracy Suppression Act, which aims to protect cargo vessels against pirates, especially in the coastal area near Somalia. The bill authorizes armed security on vessels carrying cargo for US agencies through high-risk waters. The reason for this dramatic change of stance has been because the presence of armed operatives has resulted in zero hijackings. With this, seafarers would be allowed to do what they are best at, i.e. seafaring and professionals will be allowed to take care of their security concerns.
